SB627 HFA Shaffer 3-7

 

                Delegate Shaffer moves to amend HJUD AM 3-3 to SB627 on page 3, section 23, lines 14 through 20, by striking out subsections (b) and (c) and inserting in lieu thereof, the following:

                “(b) This section does not create a private cause of action against a physician for declining to prescribe, or declining to continue to prescribe, any controlled substance to a patient which the physician is treating, for harm occurring to the patient resulting from the physician’s medical judgment when he or she believed the patient was misusing the controlled substance in an abusive manner or unlawfully diverting a controlled substance for patient’s use, unless the physician failed to exercise reasonable care.”
